Compliance Monitoring
A sustained level of compliance with the Authorized Provider (AP) or Licensed Standard User (LSU) requirements is essential for maintaining approval status. Therefore, IACET reserves the right to randomly and directly monitor compliance with the IACET AP or LSU requirements and to investigate complaints of possible violations of the requirements of the AP or LSU agreement.
IACET will notify the AP or LSU in writing if the AP or LSU is under review. IACET will send the AP or LSU a written notification of the results of its compliance review upon completion of the review. IACET may use a variety of monitoring techniques, including any or all of the following:
Review of records required in the application process and/or AP or LSU agreement. Records may be reviewed at the AP’s or LSU’s location, the IACET office, or another location determined by IACET. Visits and assessment of specific documents related to the AP or LSU relationship with IACET. Investigation of complaints or information regarding alleged violations of the IACET requirements, the AP agreement or the LSU agreement. Self-assessment conducted by the AP or LSU. Request the AP or LSU resubmit an application so that IACET may determine ongoing compliance.
Revocation of Approval
If the compliance review results in a noncompliance decision, the AP or LSU will receive a written warning of potential revocation or approval. The AP or LSU will have 60 days to comply with their most recent signed agreement or notify IACET of extenuating circumstances that prevent compliance. IACET reserves the right to make a decision on whether to grant a greater period of time for compliance.
If a longer period is granted, the AP or LSU must comply within that period or the approval or license will be revoked. A written letter of revocation will be sent to the AP or LSU. No annual fees will be refunded.
APs or LSUs whose approval has been revoked may re-apply one year after revocation.
Right to Appeal
When IACET denies or revokes the AP or LSU status, that decision will be forwarded to the AP or LSU in writing and will indicate IACET’s reasons for denying or revoking the status or license. The AP or LSU may appeal the decision, using the process detailed here.
